Terms of Service

These Terms of Service (“Terms”) govern your use of the JFS Customs website and your purchase of products and custom work from Melanie Cullen, operating as “JFS Customs” (“we,” “our,” or “us”), a sole proprietorship based in Wetaskiwin, Alberta, Canada.

By using our website or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the website or place an order.

JFS Customs is a custom apparel, glassware, and engraving shop. We offer two ways to order:

• Stock products — ready-made items at set prices, bought directly through the website and shipped or picked up locally.
• Custom orders — bespoke items produced from your specifications and artwork. You submit a request through our quote form, and we reply with a price. Custom orders are produced only after you approve a quote and proof.

We may change, add, or discontinue products at any time.

You may check out as a guest, or create an optional account using “magic link” sign-in (no password). You agree to provide accurate, current, and complete information when you order, and to keep your contact details up to date so we can fulfill your order.

All orders are subject to acceptance and to availability. We may refuse or cancel an order — for example, where an item is mispriced, out of stock, or where we reasonably believe the order is fraudulent or violates these Terms. If we cancel a paid order, we will refund the amount paid for the cancelled items.

Prices are shown in Canadian dollars (CAD) unless stated otherwise. We may change prices at any time, but changes do not affect orders we have already accepted.

Payment: card payments are processed by Stripe. By providing payment information, you authorize Stripe to charge your selected payment method. We do not store your full card number.

Taxes: prices do not include GST/HST. While JFS Customs is a small supplier and is not registered for GST/HST, no sales tax is charged. The checkout is built to add applicable sales tax (such as GST/HST) automatically, where required by law, if and when a GST/HST number is in place.

5.1 Your Artwork — Rights and Responsibility

When you submit artwork, a logo, a photo, text, or any other design for a custom order, you represent and warrant that:

• You own the design or have all rights and permissions needed to use and reproduce it; and
• The design does not infringe any copyright, trademark, right of publicity, or other right of any third party, and is not unlawful, defamatory, or otherwise objectionable.

We do not pre-screen or verify the rights to customer-supplied artwork. You are solely responsible for what you ask us to produce. You agree to indemnify and hold us harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising from the artwork you supply or from our production of your custom order based on it.

5.2 Proof Approval

For custom orders, we provide a proof or mockup for your approval before production. Once you approve the proof, you are responsible for its content — including spelling, layout, colours, sizing, and placement. We are not responsible for errors in an approved proof, and approved orders cannot be changed or refunded for those reasons once production has begun.

5.3 Colour and Variation

Printed and engraved colours may differ from what you see on a screen, because screen (RGB) colour does not translate exactly to printed or engraved (CMYK / physical) results. Minor variation in colour, tone, placement, and finish is a normal part of custom production and is not a defect.

5.4 Garment and Material Substitution

If a specific blank garment or material becomes unavailable, we may substitute a comparable item of equal or better quality. We will let you know where a substitution materially affects your order.

5.5 Quote Validity and Cancellation

Custom quotes are valid for 30 days from the date issued, unless stated otherwise. You may cancel a custom order before production begins. Once production has started, the order cannot be cancelled, because the items are made specifically for you.

Custom and personalized items are final sale. Because they are made specifically for you, they cannot be returned or refunded for change of mind, incorrect size chosen, ordering error, or buyer’s remorse.

We will repair, replace, or refund a custom item only where it is defective, misprinted against the approved proof, damaged in shipping, or where we sent the wrong item. Please contact us promptly with photos so we can make it right.

Stock items: unworn, unwashed stock items in original condition may be returned within 30 days of delivery for a refund or exchange. Return shipping is the customer’s responsibility unless the item was defective or incorrect.

We ship across Canada and offer free local pickup in Wetaskiwin, AB. Shipping times are estimates, not guarantees. Once an order is handed to the carrier, delivery is in their hands; we are not liable for carrier delays. Risk of loss passes to you once the order is delivered or made available for pickup.

Unless you tell us otherwise in writing before production, you grant us a non-exclusive, royalty-free licence to photograph and display finished work we produce for you — including custom orders — in our portfolio, gallery, website, and social media, to show examples of our work. This licence covers the finished product only; it does not transfer ownership of your underlying artwork to us. If you would prefer we not display your order, just let us know.

You agree not to use our website to:

• Violate any law or the rights of others, including intellectual property rights.
• Upload artwork or content that is unlawful, infringing, defamatory, obscene, or otherwise objectionable.
• Send spam or unsolicited commercial messages, or interfere with or disrupt the website or its security.
• Attempt to gain unauthorized access to our systems, other users’ accounts, or our service providers.

We may investigate violations and take appropriate action, including cancelling orders, suspending access, and referring matters to law enforcement where appropriate.

Our content: the JFS Customs name, logo, website design, text, and graphics (other than customer-supplied artwork) are owned by us and protected by law. You may not copy or reuse them without our permission.

Your artwork: you keep ownership of the artwork you supply. You grant us the licence needed to produce your order and the portfolio licence described in Section 8.

We display certain branded or fan-themed designs in our gallery only as examples of our capabilities. These are not for sale, and we do not claim any rights in the underlying brands or characters.

Our website and products are provided on an “as is” and “as available” basis to the fullest extent permitted by law. We do not warrant that the website will be uninterrupted or error-free. Nothing in these Terms removes or limits any rights you have under Alberta’s Consumer Protection Act or other applicable consumer protection law that cannot be waived.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Some of these limits may not apply where prohibited by applicable consumer protection law.

You agree to indemnify and hold us harmless from any claim, loss, liability, cost, or expense (including reasonable legal fees) arising from your breach of these Terms, your violation of any law or third-party right, or the artwork or content you supply to us.

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there, without regard to conflict-of-law rules. If you have a concern, please contact us first — most issues can be resolved quickly that way. Subject to any consumer protection rights you have under applicable law, any dispute relating to these Terms or your order is subject to the courts of the Province of Alberta.

We may update these Terms from time to time. We will post the updated Terms on this page with a new “Last updated” date. Your continued use of the website or placing of an order after changes take effect constitutes acceptance of the updated Terms.
